State Sen. Kurt Fevella challenges West Oahu primary tiebreaker in court
HONOLULU (HawaiiNewsNow) – State Sen. Kurt Fevella is appealing to the Hawaii Supreme Court after a tied primary election was decided by a random drawing.

In the Senate District 20 Republican primary, former lawmaker Bob McDermott and incumbent state Sen. Kurt Fevella finished tied with exactly 1,212 votes each.
The drawing followed Hawaii Revised Statutes Section 11-157 to determine the winner of each race.
McDermott was subsequently declared the winner of the race following the drawing.

Though Fevella missed the official deadline to file a challenge with the high court, he filed a motion anyway. In the filing, Fevella apologized for the delay, explaining that the situation is “new territory” for him.
On Friday, the Hawaii Supreme Court officially ordered a new election for State Representative District 43, another tied Republican primary.

There is no word yet on whether the Supreme Court will agree to hear his case.
